About this office equipment lease agreement

This template records the terms of a lease of office equipment to a business. The agreement suits all types of equipment, from small portable items such as mobile phones or laptops, to large, less easily moved items such as office furniture to air conditioning equipment.

The lease could be for a long or short fixed term or on a rolling basis. We include the option for purchase of the equipment after a certain time, i.e. you can edit it to be a finance lease or an operating lease.

This equipment lease agreement is a comprehensive and flexible document suitable for any term and any equipment. It covers every reasonable angle, providing both a statement of the commercial terms and a very firm basis of rights of both parties. This lease principally protects the lessor of the equipment but fairly treats the lessee.

When to use this agreement

Since this agreement does not take account of the consumer credit and other consumer protection law, it can only be used to lease equipment to a business (and not to the general public).

The lessor could be an individual or a business. It might therefore be used by:

  • a business owner leasing his own equipment to his business;
  • a B2B equipment leasing company;
  • a business with spare equipment that wants to make use of it by leasing it to another business;
  • one company within a group of companies leasing to another company in the group.

The law in this document

The advantage of not taking account of consumer protection law is that you are free to make the deal you want without having to look over your shoulder at government regulations (although, of course, there is a raft of legislation about operation of almost any equipment).

To make your life easy, we have provided multiple options in many areas including responsibilities for maintenance, payment of the lease rent, options for buy-out at the end of lease, options to extend the lease and much more.

Features of this office equipment lease agreement

This office equipment lease agreement is extremely comprehensive and written in plain English. It has been drawn for maximum flexibility and ease of use.

Key features are:

  • The term of the lease can be as long or short as you like, from months to years. We suggest a short period so that the contract can be renewed and terms (such as the rental amount) updated.
  • Segregation of legal wording from the commercial terms. This keeps the "legal" wording of the commercial transaction separate to the "subject matter", creating an agreement that is easier to read, amend and reuse.
  • The document may be used regularly or once only for a particular deal.
  • Flexible rent and payment plans
  • The rent might be a simple monthly or annual payment or may be variable. The buy-back arrangement is an option you can include or delete.

Contents of this agreement

  • Options for lease rentals
  • Warranties and exclusion by lessor
  • Testing and checking of equipment by the lessee and conditions of acceptance
  • Prohibition on selling and subletting
  • Termination, premature termination
  • Optional provision for deposit
  • Option of guarantor
  • Buy-out provision
  • Option to extend lease term
  • Set of lessee’s obligations
  • Intellectual property rights
  • Lessee to indemnify lessor
  • Other important legal and commercial provisions

For items that would not be classed as office equipment, our equipment hire agreement might be more suitable.

It is with some reservations that I took the decision to spent $48.00 on an agreement model, because some time you get the most elementary leaving you with a lot of questions.
But with you guys I hit the jackpot. I was looking for a lease contract for Multi Functional photocopiers/printers, and I settled for your Office Equipment lease agreement.
What I got was a model that fitted perfectly for photocopiers with the minimum of changes with an explanation for every article and as the cherry on the cake you sent me the Guidelines. Perfect!!!
Congratulations for supplying you customers with the best on the market.

Excellent content, best info and offer on the web, all avenues covered or adaptable, saved hundreds of pounds and hours of trying to work with a solicitor.I would definitely recommend Net Lawman and will use them again when reviewing our existing contracts.

Using the formatting facilities of Word more effectively i.e. TOC, Headings etc would improve the format and editing of the document
